Terms of service

The quick version

1. Boldcall is a game. No money goes in, none comes out.
2. Points are bragging rights. They're not worth cash and you can't trade them.
3. What you write is yours. We just need permission to show it to your group.
4. Don't be cruel to people. We can remove posts and accounts that are.
5. The app comes as is, our liability is limited, and North Carolina law applies.

That's the gist. The sections below are the actual terms.

Saying yes

These terms, plus the privacy policy and the community rules, are the agreement between you and Agori Labs Inc. ("we"). Making an account or using Boldcall means you agree. If you don't, please don't use it. Just looking around counts too.

Who can play

You have to be at least 13. If you're under 18 (or under the adult age where you live), a parent or guardian has to agree to these terms for you. If an app store tells us a parent's OK is needed or was taken back, we follow that. You can't use Boldcall if we've removed you before or if the law says we can't serve you.

Your account

You sign in with Apple, Google or a code sent to your phone. Whoever controls that sign-in controls your account, so keep it locked down. Think someone got in? Email hello@boldcallapp.com. One account per person. No pretending to be someone else, no bots, no selling accounts. You can delete yours anytime. Here's how.

What you can post

You post calls, picks, dares, votes and trash talk, and you're responsible for them. Follow the community rules. The short version: no harassment or threats, no hate, nothing sexual involving minors, no posting people's private info, nothing pushing self-harm, no pretending to be someone, no spam, nothing illegal.

Also, don't try to peek at secret picks or game the rankings. That means no hacking, changing your phone's clock, modding the app, scraping, or running extra accounts to swing a split. It won't work, and it breaks these terms.

No real money

This one's a rule, not just a vibe. Boldcall has no entry fee and no prizes. Don't use it to track, set up or settle any bet or anything worth money: cash, gift cards, crypto, stuff, or payments through other apps.

Dares have to be things you do, not things you pay. We strip out money symbols, currency words and payment app names. We don't hold, check or enforce any dare, and we're not part of whatever you and your friends agree to. Using Boldcall for gambling gets you removed. Why there's no money.

Points aren't worth money

Points, streaks, stats and rankings are part of a game. They're not property, currency or a balance. You can't buy, sell, trade, cash out or swap them for anything. We can fix or wipe points if results were wrong, a bug messed something up, or a vote was rigged. If Boldcall ever shuts down, points go with it. We'll give you notice and a way to save your group's history.

Your posts

What you post is yours. You give Agori Labs a non-exclusive, worldwide, royalty-free license to host, store, copy and show it, only to run Boldcall: showing it to your group, keeping picks secret till reveal day, and keeping your group's history. That license ends when the post is deleted, except for backups that roll off on schedule and picks kept as "a former member" (see the privacy policy).

We won't use your posts in marketing without asking, and we won't publish your group's calls. If you send us ideas or feedback, we can use them without owing you anything.

Our stuff, and outside info

The app, its design, the ready-made calls, the stats pages and the Boldcall name and logo belong to Agori Labs or the people who license them to us. Use them to play. Don't copy or resell them.

Ready-made calls are conversation starters, not facts or predictions. Schedules, scores, race info and any labeled poll average or forecast come from outside sources and can be late or wrong. Nothing in Boldcall is betting, money, legal, medical or voting advice. For how and where to vote, go to vote.gov.

Results

Results come from live scores, a group vote, a group admin, or, for calls Boldcall posts that scores can't answer, a Boldcall reviewer who cites a source. The details are in how results work. A result is a score in a game, not an official ruling on what happened in the world. We can't promise every result will be right or on time. If we spot a wrong one, we may fix it. Arguments inside your group belong to your group.

Getting removed

We can remove posts, turn off features, or suspend or close accounts that break these terms or the community rules. For the serious stuff (threats, anything sexual involving a minor, nonstop harassment) we act right away without warning. Otherwise, we'll usually tell you what happened and how to appeal. A group admin can remove someone from their group. That doesn't touch the rest of the account.

You can leave anytime by deleting your account. Some parts of these terms keep applying after that, like points having no cash value, the license for kept picks, the disclaimers, liability limits and dispute rules.

Apple and Google

If you got Boldcall from the App Store or Google Play, this agreement is between you and Agori Labs, not Apple or Google. They aren't responsible for Boldcall, its support or any claims about it (including product, legal-compliance and intellectual-property claims), and they don't owe you any warranty for it. Apple and its subsidiaries are third-party beneficiaries of these terms and can enforce them. You confirm you're not in a country under a US embargo and aren't on a US government restricted list. The app store's own terms apply to your download too.

No guarantees

Boldcall comes "as is" and "as available." As far as the law allows, we don't make any promises, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We don't promise Boldcall will always be up, bug-free or secure, that scores will be right, or that a notification will show up.

Limits on liability

As far as the law allows, Agori Labs and its people aren't liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, from your use of Boldcall. Boldcall is free, so our total liability for any claim about it is capped at $100. Some places don't allow these limits. There, they apply as far as the law lets them, and nothing here limits anything that legally can't be limited.

If you break these terms or the law and someone brings a claim against us because of it, you agree to cover our reasonable costs from that claim, as far as the law allows.

If we disagree

Got a problem with us? Email legal@boldcallapp.com first and give us 30 days to sort it out. If that doesn't work, either of us can go to court. North Carolina law applies (not counting its conflict-of-law rules), and cases go to the state or federal courts in Mecklenburg County, North Carolina. You can still use small claims court where you live. There's no forced arbitration and no class-action waiver here. If that ever changes, we'll give notice before it applies.

Changes and the rest

We may update these terms. For changes that matter, we'll update the date, log it on policy updates, and tell you in the app at least 14 days before they kick in (sooner only if the law or safety needs it). If you keep using Boldcall after that, you're agreeing to the new terms. If you're not into them, delete your account.

If part of these terms can't be enforced, the rest still counts. If we don't enforce something, we haven't given up the right to. You can't transfer these terms to someone else. We can, if we merge, get bought or sell. These terms, the privacy policy and the community rules are the whole agreement about Boldcall.
